Reality star, Kim Kardashian, filed for divorce from NBA player, Kris Humphries, Monday, after a mere 72 days of marriage.
Kardashian is not seeking an annulment of the marriage, instead opting to file for divorce, citing irreconcilable differences.
Although both divorce and annulment are methods of dissolving a marriage, annulment declares a marriage null and void, considering the marriage invalid from the start. Some areas of jurisdiction only recognize the marriage as void from the date of the annulment instead of the date the marriage began.
There are two types of annulment: Civil Annulment and Religious Annulments. Civil annulments can usually be completed if:
•· One party was underage
•· If the person asking for the annulment was under the influence of alcohol or drugs
•· If one party concealed a divorce (within the past 30 days)
•· If the marriage took place less than 72 hours after the license was issued
•· Permanent impotency
•· Mental incapacity
•· Consanguinity (being too closely related)
According to reports, the couple did sign a prenuptial agreement prior to tying the knot and Kardashian is reportedly trying to block Humphries from receiving any spousal support from her.
