Carlson Duo Secures Settlement For Grieving Family Following Company Vehicle Crash

On August 8th, 2016 Mr. Jose Mireles was driving on an overpass on Highway 281 in San Antonio during rush hour traffic, when suddenly and without warning his 1991 Ford Mustang was struck from behind by a Ford F250, operated by an employee of IES Commercial.

The force of the impact sent Mireles’ vehicle spinning, and it was struck a second time; this time on the side, by the IES company truck.

The father of three died at the scene.

“We were lucky that the family was courageous enough to come forward as soon as they did to seek help,” explained Attorney Dummitt. “This allowed us to preserve the evidence of their father’s vehicle, which proved to be instrumental in the crash reconstruction analysis. Within an hour after the deceased was transported from the crash scene by the medical examiners, the defenses’ experts had already performed a scene exam in order to craft the defense that the defendant driver was obeying all traffic laws and was cut off.”

Attorneys Dummitt and White were able to uncover evidence that supported the fact that the IES driver was severely fatigued from lack of sleep, which proved an impaired state was the cause of the accident.

“Through exhaustive investigation, we proved the accident was caused by the company driver, who had less than 2 hours of sleep in the 24 hours prior to the deadly collision,” said Attorney White.

Although the driver was not acting within the scope of his employment at the time of the crash, IES was still held accountable for their negligence that played a part in this senseless tragedy.

The settlement is reported to be one the largest this year involving a commercial vehicle.
