Carlson Secures Settlement For Injured Good Samaritan

The Carlson Law Firm successfully secured a $305,000 total settlement for a good Samaritan who was injured while trying to save the life of the victim of a hit and run incident.

On May 25th, 2015, a client of The Carlson Law Firm was celebrating her birthday with friends at a restaurant on Highway 195 in Killeen, Texas when she heard a loud crash, followed by a cry for help from the road directly in front of the establishment. The client, a dedicated Army nurse, immediately rushed to the scene to help, where she learned that a pedestrian was struck in a hit and run accident. She immediately began to apply her nursing skills in an attempt save the pedestrians life. At the same time, several other restaurant patrons were directing traffic away from the road so that she could safely apply aid.

Despite the several warnings, the operator of a vehicle traveling toward the accident scene panicked upon seeing the large group of people in the road, sped up and struck the incapacitated pedestrian as well as our client.

Because of the violent nature of the impact, our client sustained significant personal injuries, including a traumatic brain injury, contusions, and abrasions on multiple parts of her body. After being discharged from the hospital, she continued to suffer from significant pain, for which she had to seek medical treatment including multiple knee surgeries and several rounds of epidural pain management.

As a result of this collision, our client was unable to perform the duties and tasks required of her as a nurse. She continues to suffer from short-term memory loss and struggles to communicate clearly. To make matters worse, she received significant pushback from her own health insurer, the opposing driver’s insurance, and her own auto insurance carrier, when she sought assistance in recovering for her medical bills. Specifically, the auto insurance companies blamed her simply for being on the road while she was trying to save a fellow human being’s life.
