Fatality rate a staggering 98% for drivers hit by 18-wheeler

There are about 500,000 trucking accidents that occur every year in the United States, and about 50,000 of those trucking accidents result in a fatality according to the U.S. Department of Transportation.

Additionally, truck accidents are the cause of about 130,000 injuries every year, and in 98 percent of those accidents, the fatalities occurred to the driver or other individual in the passenger vehicle.

What you should do if you are involved in a trucking accident

If you are involved in a trucking accident you should contact an attorney as soon as possible. It is important to have documented statements from the truck driver, law enforcement officers and other witnesses to the accident who may be able to contribute information about weather conditions, traffic lights, visibility, whether the driver appeared to be driving intoxicated or if they heard anything out of the ordinary. It is also important to look closely at debris from the accident, skid marks on the road or damage to the vehicle. It is important to get as much information from the scene as possible to help in your case.

Was the accident your fault?

Maybe not! There are ways to investigate truck driving accidents to determine if the truck driver or trucking company is at fault. The Federal Motor Carrier Safety Administration mandates that trucking companies must maintain driver qualification files, which include information about the driver’s:

· Driving records

· Results of drug and alcohol tests

· Results of road tests

· Records for service hours

· Training certificates

· Medical certifications

· And records of annual reviews.

The Driver qualification file also contains the vehicle’s maintenance records.

If the driver of the truck doesn’t have a valid commercial license, isn’t at least 21 years old, can’t read and speak English, cannot safely operate a vehicle, isn’t in good health, or can’t properly load and secure cargo, then the driver or driving company may be at fault for negligence.

Records can be difficult to obtain so it is important to have an experienced attorney on your side.
