A second child has passed away after enduring serious injuries when the vehicle he was in was struck during a high speed chase, where police attempted to apprehend a driver following a drug stakeout on September 19th.

The boy who passed away was identified as 1-year-old Wesley Maspero. Two other siblings along with the child’s parents, were also injured in the San Antonio car accident.

According to authorities, police had been staking out a suspected drug house, stopping drivers as they left the stakeout scene. One of those vehicles was driven by David Rodriguez, whom police attempted to stop on a traffic violation. But, according to authorities, Rodriguez did not stop for police and the chase continued onto I-35.

Police identified the child who was pronounced dead at the scene of the San Antonio car accident as 3-year-old Walter Maspero. The other siblings who were injured in the collision were identified as Wynnsday, 3 months-old, and Wyitt, 4-years-old. The children’s mother, 30-year-old Regina Acosta was flown to University Hospital with the children.

Authorities said Rodriguez is being charged with capital murder in the deaths of the two children.
