On October 13, 2016, our client, Tyrell Jackson, was riding his motorcycle on Stan Schlueter Loop in Killeen, Texas. At the same time, a driver in a Toyota Rav4 was leaving the local post office. The driver pulled out into oncoming traffic to make a left turn. The driver allegedly did not see Jackson’s Kawasaki Ninja ZX driving down the 55 mph roadway until it was too late. In the blink of an eye, Jackson’s bike crashed into her vehicle. The sheer force of the crash threw him 50-feet from the initial impact site.

According to the police report, the driver of the Rav4 was deemed at-fault for the crash. Killeen Police issued a citation for failure to yield the right of way to oncoming traffic.

In the moments following the crash, first responders assessed the situation for damage to vehicles and persons involved. Jackson’s injuries were so extensive that first responders called an air ambulance to the scene. He was airlifted to Scott & White Hospital in Temple. Because of the crash, he suffered fractures in both arms and hands, left shoulder, legs, radius, as well as cuts in his leg tendons. Additionally, Jackson suffered a severe traumatic brain injury. Because of injuries, he has incurred more than $200,000 from his medical treatment and rehabilitation.

In the nearly two years since his accident, Jackson has returned to work as a U.S. Soldier. An unfortunate consequence of the crash is that his injuries are a hindrance to his performance. He has ongoing leg pain whenever he runs or jumps and is still unable to fully grip his firearm while performing work-related duties. He continues to suffer from headaches and cognitive impairment. While he still has life, the quality of his life has greatly diminished because of the injuries he sustained from another driver’s negligence.

It is important to recognize the true extent of Jackson’s injuries. The initial or continued physical suffering wasn’t the beginning or the end of the extensive his injuries. He has since struggled with depression and anxiety because of the decrease in the quality of his life. Further, Jackson, a husband and father, was hospitalized for almost a month causing his family emotional suffering from the near loss of their father and husband.

The injuries that Jackson sustained are preventable. His story is a warning to all drivers on the road to look out for motorcycles. Because of their size, motorcycles can be difficult to spot. Riders are likely to bring their bikes out when the weather is nice, but drivers should be alert, no matter what the weather is.
