  • Know that you can refuse field sobriety tests. 
  • Know that you can refuse breathalyzer tests. It is important to note that refusal to take a requested breathalyzer test will trigger an automatic driver’s license suspension under Texas’s implied consent law and Texas Transportation Code § 724.015. However, even if you take the breathalyzer, your license could be automatically suspended depending on the results.

If you are arrested, contact a DWI lawyer immediately. In Texas, a first-time DWI offense with a BAC of .15 or higher carries significantly harsher penalties than one with a lower BAC level. 

If convicted, you could face a maximum fine of up to $4,000, a jail sentence with a mandatory minimum of 30 days in jail, with the possibility of up to 1 year, or a driver’s license suspension for a period ranging from 180 days to 2 years.
